To learn more about Conti Federal, please visit http://www.contifederal.com/ The Subcontracts and Compliance Manager will be responsible for providing subcontract authoring and compliance support for construction services, ensuring subcontractor compliance and efficient subcontract administration through the drafting, negotiation, administration, change order modification, termination, and close out of all company standard and nonstandard subcontracts and agreements for Federal projects. Oversees cradle-to-grave subcontract, procurement, and compliance management of all subcontracts and material suppliers. Responsibilities Pre-Construction Support: + Qualifies prospective new subcontractors and suppliers and ensures compliance requirements met during pre-construction process. + Develops and monitors strategies for prudent subcontracting with special emphasis on small/minority business subcontracting. + Verifies and maintains the monitoring of subcontractor qualifications and updating as needed. Construction Support: + Drafts and negotiates subcontracts, purchase orders, teaming agreements, non-disclosure agreements, master service agreements, etc. + Receive and review requisitions for completeness, clarity, and conformance to established policies. + Prepare Prime Contract specific exhibits for subcontractors and vendors inclusive of all prime flow down provisions (including liquidated damages flow downs and retention requirements), and preparation of the purchase order/subcontractor agreement package. + Provides expertise in identifying potential procurement problems or conflicts, analyzing impact/ramifications and resolving issues. + Works with subcontractors to monitor contracting requirements, including but not limited to reviewing certified payroll reports for prevailing wage compliance and lien releases. + Communicate effectively with internal and external stakeholders including Project Managers, Project Coordinators and Subcontractors. + Provide support to AP, Project Coordinators, and Project Managers. Post-Construction Support: + Ensures supplier performance evaluations are completed and used in the vendor/subcontractor selection process and other Quality requirements. + Assist with purchase order, subcontract and contract closeouts including processing and release of retention and lien waivers, as well as ensuring all final reporting requirements have been met prior to release of final payment. Qualifications + For Security Clearance Requirements – must be a US Citizen, as required. + Undergraduate degree and 5+ years of experience in subcontract management and procurement. + Experience and working knowledge Autodesk, CmiC, Procore or other similar ERP/Construction Management Systems a plus. + Must have excellent analytical skills, effective written and oral communication skills, effective negotiation skills and strong interpersonal skills. + Applicant must have a strong working knowledge of business practices and compliance requirements in the construction industry and be able to research and apply FAR/DFARS any jurisdiction-specific requirements for construction projects. + Strong technical aptitude and understanding of typical construction contract terms and conditions language and its meaning/interpretation, and ability to advise business leaders on risks associated with acceptance of modifications to key terms and provisions. + Must understand the broader impact of proposed or awarded work and contract terms on the company, be able to identify and resolve contract issues with guidance as necessary and advise program staff and management of contractual rights and obligations. + Ability to read and understand prime agreement terms and conditions and determine key risk elements that need to be explicitly incorporated into subcontractor terms and conditions. + Demonstrated experience in resolving complex contractual problems.
